Forgot to mention: For individual sellers and not entities, your sell limit is up from 200 to 500. All in all these ToS changes are good for the majority of fan creators out there and not corporations making genshin products.

This is my simple unerstanding, because I feel like you missed few details:
-if you're a fangroup (2 or more people) the max amount of PHYSICAL fan products you can sell are 200.
-if you're an individual the max amount of physical items you can sell is 500.
if you ever go over the max amount that applies to you, you have to send in a declaration to mihoyo. Basicly saying hey you have to work with us
You are not allowed to make and sell "art" items that break any law( relative to your country and the places you sell and ship too) or hurt anyone's image( mainly Genshins and Mihoyo's image ).
Any official merch from mihoyo is not allowed to be altered and sold.
the max amount of types of physical products you can make is 5. If you have for example a zhongli pin and a Venti pin you want to sell you, that counts as two types of physical products. Even if you have two identical zhongli pins that are made from slightly different materials, those two are different products you have to declare. (I am not really sure, but I think you can have more than 5 if you are a company, but company stuff wasn't insteresting to read so I didn't)

If someone takes his time making something that takes such a long time to make, like a fan art manga , he can only sell 200 copies online? (unless its face to face)..I don't think that's fair…

I agree, the fact that the maximum amount of fan art we are allowed to sell, depending on the product, is allowed to be within the 200 – 500 units is really generous of them.

Okay but… Do the ToS also affect Genshin fanart commissions? I was thinking of opening a commissions but now I'm not sure if it's still possible
This seems like a good policy to me, I commend them for the leniency compared to many other big successful properties, I figure it's symbiotic too so I'd say it's also a smart move rather than just a cool one.
Before you act like Mihoyo is "generous for being so lenient", read the f*cking comments.
This is the bare minimum they could have done.
I don't think any of you truly understand what "legal prosecution" means, especially in Mihoyo's case.
And I'm pretty sure that if they COULD, they WOULD have went with: "Everything you sell related to our IP is ours."
Pretty sure they HAD to give at least some leniency to avoid both outrage and to give artists on conventions, for example, (Because if you read the thing, you would know they are included) some room to draw that sweet sweet free Greedshin promotional material. (Some sketches or requests that just happen to be Genshin related.)
They would have been shooting themselves in the foot by going that far, considering their already established reputation.
If it were up to me, I would say we would all start mass producing and selling fan content so it gets unmanageable. I think Genshin deserves all the pushback they get, as much as I "love" (toxic relationship) this game.
IMO this feels more like a safety net for them to combat the mass production of fake goods that is widespread in China… I've already found at least ten online stores selling fake versions of the official merch on Chinese webstores and even on the webstores in my country. There are also cases where they will steal fanart from the internet and sell them without the original creator's consent (thought it's unclear if this is to combat that as well). It's also good that they are not asking for a 'cut' of the sales, they just want to make sure that the fan goods being sold are legitimate, and not just, "Here's a cheaper version of the official merch created with even cheaper material which we are totally not mass producing to steal the original designer's profits."
The next issue now is the regulation. If a fan creator does ask mihoyo for permission to create some goods, how quickly will mihoyo respond? And what criteria do they judge it by?
If a person can sell 200 printed t-shirts, that person is no a small artist or seller. Well, counterfeit products are common in china, so this is probably to avoid problems from merch sold from there.
