  5. There needs to be substantial statutory penalties for false claims. Right now, they can claim whatever they want, and if you counterclaim, you get punished, regardless of the validity of their claim. Similar to the statutory penalties present in the FDCPA. Companies would be a lot less likely to issue false takedowns if there were statutory penalties of 10 grand a pop.

  6. Youtube is a USA based site so it follows USA copyright laws regarding 'fair use', so you have all the right to submit a counter notification and protect your content.
    Don't be disheartened. I have seen many people receiving ridiculous strikes and successfully countering them.
    I even remember that one guy who got a copyright strike for his own video footage because some big tv channel aired his video without his consent and then he got a strike from that tv channel lmao
    Also it may be strike from a fake account. You may try asking mihoyo support team if "Genshin impact" account is fake and what name do they use (Mihoyo Co Ltd? Cognosphere PTE Ltd?) for their copyright strikes on youtube.

  10. The sme thing happened to Valk and a few other YouTuvers. Imagine you are enforcing the leaker hunt decree, you search YouTube using the keyword "genshin leak", then the copy strike is totally unfair due to:
    – Needing to review minutes to hours of footage in a split-second (or only reading the title and thumbnail)
    – Not being good enough at English (might misunderstand some videos that talk about leaks, not literally leaks)
    – Hoyoverse not replying to the YouTuber's emails

  12. 7:00 I wholeheartedly agree with this as a Content creator its hard for us to cover current contents in the game as it is already covered 3-4+ patches ago if they really wanted they can literally end leaks easily they've been targeting youtube channels etc. yet they haven't taken down sources of leaks ubatcha, blank etc.

    Creators covering leaks is playing with fire and risking that they can't make channels after being terminated. It sucks to be yt creator in genshin right now competing with leakers and clickbaiters.

    Their team are Soo focused on attacking people and keeping their content secret, rather than improving the game or listening to people
    Honkai community aren't even close to how bad gensbin is despite them being the same company

  18. Maybe someone in chat was writing leaks while you recorded the video and you didn't delete that part? That's why they copyrighted it. 🤔So, the reason for a strike can be not your words or video itself, but some person in chat.

  20. There's so many people get strikes for that exact reason. the strikes must be from those 2.8 stream operator, who got demoted after the fail stream from stream operator to youtube leak hunter. XD

    I was getting bored of the game, getting annoyed at the lack of content that interested me, and then I got the leaks that Sumeru and Dendro was coming, and that Baizhu may come (somewhat) soon. It got me back into the game, and I don't see how they see this as a problem.

    As a Day 1 player, the only things that keeping my fire burning are those exciting leaks.

    So many most awaited games are coming sooonest.

  31. This happened to a channel called SmackDaddyKing as well. It was total BS. They did a strike for the vaguest thing and it was supposedly of a symbol related to Heizou that they said was not revealed. But then Smack went and found the same symbol in the drip marketing on Twitter. YouTube's copyright system is honestly awful. Even if they did get angry that you mentioned that the leaks exist, that is not grounds for them to strike down your video.

  34. This is really the best example to explaining double standards. And no I don´t mean EroticWalruss, I mean the whole situation. If I search for Sumeru Leaks on Youtube I can find so many videos and I bet you can see them after monnths of Sumeru release. So it seems, these people are not getting strikes? The people who literally SHOW leaks. But then they attack (yes I see it as an attack) Erotic because he had the words in his title? This is so ridiculous… Maybe you can censor the title from now and write it like: S*** L****, so they have to watch the video to understand what you mean. XD

    Tbh I´m not a 100% fan of leaks. I think it´s interesting to know which character we are gonna get but I definitely don´t wanna see any quests, stories or cut scenes because at the end of the day I wanna witness it myself when I visit the new region.
