Tbh it would be better if discord did hire a certain number of beta testers and actually have a contract with them so they can sue them easily if they leak anything, i know leaks what makes it tempting for the future updates but for mihoyo it means they just have to meet everyone's expectations and if they dont they are going to lose money.
This isn't a law suit against discord this is simply a petition. These two things are drastically different

Honestly, I'm glad Hoyoverse/Mihoyo is finally cracking down on these leakers. I despise leaks so much. Or rather, leaks being fed to me regardless if I want to see them or not. I don't really care if leakers do their thing with a closed group of friends or people, but uploading shit like "OMG [NEW WEEKLY BOSS] IS INSANE" (with a thumbnail of that boss). PLEASE STOP DOING THIS! I tend to watch Genshin stuff on YouTube, so it is out of my control to not get those things recommended to me. Similarly with Twitter, people who I follow may end up liking such tweet and gets visible to my timeline.
With that said, I've been pretty fortunate to not have things leaked to me for the last couple of versions. But still, it's frustrating.
They need to get some of those Instagram accounts too. Thereâs a lot of them on there.
I wander why FBI isn't sueing discord for literally having weed and drug cartels but genshin is sueing discord for a guy who said the next characters name……

They didnât just leak some ânames and lines about the characterâ but images, events, new mechanics/features, quests and storylines too, literally spoiling months worth of content. Hoyo had warned them repeatedly yet none took it seriously enough. Thereâs drama behind this too. Each of them wanted to one-up the other leakers so the more they went on, the more content got leaked. At this point itâs not even about âhelping players save resourcesâ anymore, theyâre just looking to stroke their own egos. Thatâs why it got that bad and honestly I really appreciate Hoyo for doing this. Itâs about time.

Discord has no reason to give any information at all unless there's serious lives at risk.
Why would anyone use discord if they knew any giant company or government could access information about them for any reason?
Law student here: serving a subpoena doesn´t count as a lawsuit, it´s a procedure where an attorney presents a request to an organization to get specific information that otherwise isn´t easily avaliable

So I'm willing to bet that Hoyo doesn't actually want Ubatcha for any sort of putting him behind bars for distributing leaks reasons. I think they're subpoenaing Discord to get Ubatcha's information, so that they can Subpoena HIM for info on the people who actually broke NDA to get beta info to him to leak. Since he hasn't actually done anything inherently worth jailing him for, I can only assume it's for the sake of either putting him behind bars for failing to comply with a subpoena if they can prove he has info on the people who did break NDA and he doesn't provide it, or getting the info out of him so that they can go after those people instead. One way makes an example out of him and results in him getting time but everyone who gave him info going free, one results in him going free but everyone who gave him info being prosecuted. The only way I see this turning out somewhat okay is if he gets rid of literally any evidence that he has any sort of info on who has given him leaks in the past, since you can't subpoena someone for info you can't prove exists. And even then, he's out of the leaking game for good because you can't have your info be given to Hoyo and then go back to leaking not expecting something bad to happen.

From my perspective, they cannot sue discord because the leaks were on Twitter. The discord user being the owner of the twitter account or not cannot and should not be proved. As Discord said in their policy, they do not provide the user data to third parties (including advocates), except AWS and Google Cloud which they run their servers on. (An advocate is not part of the law enforcement so even if they say so, cannot request data) The fact that the content is hosted on twitter (they attack the user for leaking, not sharing leaks) changes everything as discord only displays the content from twitter, from the screenshot I've seen in the files, it's all links, and discord uses Twitter's API to show the images and text in their embeds, thus them not suable for this specific case. If they want infos they have to ask Twitter, not discord. It's like those porn sites that showcases extremely questionnable stuff but cannot be sued because the content is hosted on a server which is simplay very hard to reach to. This advocate had some history with videogames company but no programming, networking and tech experience in general.

If they only leak about future playable characters i think it's still fine because it's a good thing for those people that are trying to save primos, but the whole cutscene/storyline leaks is just too much. It's like spoiling a whole movie. The feeling of unexpected of what to come in the future storyline or a surprise character appearance just disappears, since you already know what's coming. It's their fault tbh.
A lot of people here only see the leaker scene as the click baiter ones. But on the subreddit, they are so critical of spoiler tags, so people won't see what they didn't want to see. and on twitter they include keywords such as "leaks" and "spoilers" so people can mute those words and not see them.
Leakers get a really bad image on a lot of stuff, but leakers hate those clickbaiters just as much as you guys.
Honestly, clickbait leakers won't be stopped unless Hoyoverse does Genshin Betas like Honkai Betas
Only start the beta after the character is fully revealed and make the beta footage and info public.
Like once CN reveals the new character, a few days after that they would start the beta, and the beta is very public.
Changes from v1 to v2 to v3 of the beta is public, nerfs and buffs is public.
